THE TERMS AND CONDITIONS BELOW HAS LEGAL TERMS. IT IS YOUR SOLE RESPONSIBILITY TO READ THE CONTENT BELOW CAREFULLY.
By utilizing our service to reserve vacation or tour package services, you (a) confirm that you have read and understood these terms, and (b) agree to these terms. If you do not agree to these terms, please refrain from using our service.
These Terms and Conditions (the “Terms”) are significant as those, along with your booking confirmation email and/or invoice, outline the legal terms under which Vacation Services are provided to you through MyVacayHost LLC (“MyVacayHost”, “we”, “us”, or “our”) Service. They also govern any type of communications you have with us via our Service. By booking Services through us, you agree to be bound with these Terms.
1. Using our Service.
a) Booking Confirmations: All booking documents are provided in electronic format. You will receive communication via email, which may include itinerary, maps. accommodations, inclusions/exclusions etc. These attachments should be read, printed, saved, and kept for your reference.
b) MyVacayHost does not own, manage, control or operate any aircraft, ground transportation, hotel, resort, cruise ship, restaurant or other suppliers associated with the assembly of your Vacation or Tour package.
c) MyVacayHost uses third party content on its website to provide detailed information from its various partners. We strive to keep the information on our website up-to-date and accurate, and any updates are posted when new information becomes available. However, MyVacayHost cannot be held responsible for any inaccuracies or omissions. Information from third parties on our website is provided solely as a guideline.
d) Third-Party Booking Services: If you are redirected from our Service to a third-party booking service (such as for payment verification or travel insurance) to complete a booking, please note that any bookings made through these services will be with the third party, not us. We are not responsible for any bookings made through third-party services and have no liability for such bookings. The third-party service provider's terms and conditions will outline your rights and explain their liability to you.
e) Confirmation of Booking: All booking documents are provided electronically. You’ll receive updates through email, which may include attachments. Please be sure to review, print, or save these attachments for future reference.
f) Booking through your agent: If you’re booking through a travel agent or third-party service, make sure to communicate your plans, expectations, and requirements clearly with them before your reservations are finalized (i.e., before your booking is confirmed). It’s your agent’s responsibility and not Myvacayhost in case things are not aligned.
2. Adherence to Rules and Restrictions
a) You agree to comply with the terms and conditions set by the Tour Providers and/or our other partners/sub-partners you choose to engage with, including but not limited to any vehicle usage, a property’s terms, and a car rental company’s rental agreement, as well as any terms related to your selected destination.
b) In order to make a booking, you must agree to the terms and conditions, which may include payment obligations, refund policies, penalties, availability restrictions, and use of fares or services. These terms will be provided to you prior to booking and are incorporated into these Terms by reference. If you breach our partners’ rules or restrictions, your booking may be canceled, and you may be denied access to the relevant Service. Additionally, you may forfeit any payments made for the booking, and we or our partner may charge your account for any costs incurred due to this breach of agreement.
3. Service Conditions:
a) MyVacayHost does not own, oversee, operate or control any accommodation, transportation, stays, restaurants or other suppliers of service associated with your vacation package.
b) Bookings and Confirmations: All bookings and confirmations are provided in electronic format. You will receive an email containing attachments, which may include details about your package. These attachments are meant to be read, printed/saved, and kept for future reference, if needed.
c) MyVacayHost utilizes third-party content on its website to offer detailed information from various Service Providers of Vacation package. We strive to keep the information accurate and up-to-date, with updates posted on our site whenever new details become available. However, MyVacayHost is not liable for any inaccuracies or omissions. Please note that the third-party information provided on our website is meant to serve only as a guideline.
d) Intermediary or Third-party Agent: If you are a third party agent booking for your customer (the end-user of packages), it’s your responsibility to provide us with the accurate information (as are shown in Government issued documents) about the user of the packages. MyVacayHost is not responsible for any discrepancies in this regard.
4. Payment and Pricing
a) Price and Currency: The prices of all our vacation packages are in US Dollar. The price of the vacation package will be displayed on our website as well as confirmed at the time of booking. Due to dynamic nature of the price changes, MyVacayHost will re-check and confirm the price at the time of booking. The price will also appear on your invoice, and you are responsible for verifying all the information on the invoice upon receipt.
b) Pricing Changes: Prices for vacation packages are subject to change at any time due to the dynamic nature in this industry. It’s likely that price of the same package may be different from another customer due to the time of booking, promotional offers at the time and a host of other factors. Price changes will not impact bookings that have already been accepted, except in the case of obvious errors. Prices or information may vary during your next visit or session on our website. While we make every effort to ensure the displayed prices are accurate and updated, we reserve the right to correct any pricing errors or change on our Service.
c) Cancellation due to error in pricing: If the price of any package displayed incorrectly on our website, we reserve the right to inform you of the error within a reasonable time and cancel your reservation at the incorrect price. In such cases, we will promptly issue a refund of all payments received for the reservation upon its cancellation.
d) Price Inclusions/Exclusions: The price only covers the vacation package specifically listed in your booking at the time of purchase. Please refer to your specific vacation package for details on what is included. Any items not explicitly mentioned in your booking at the time of purchase are excluded from the price. It is your responsibility to review your booking documents. If you have any questions or concerns about pricing relating to inclusion or exclusion, please contact MyVacayHost before making any payment.
e) Full Payment: Full payment is required at the time of booking
f) Waiver of Chargebacks: If you are paying by credit card, you acknowledge and agree that in the event of cancellation, you will be subject to the cancellation policies outlined in these Terms, and you will waive your right to request a chargeback, except in cases of fraud. If you request a chargeback that we need to dispute, you will be responsible for all associated costs, including a minimum fee of $95 per instance, along with reasonable attorneys' fees.
g) Payment Processing:
1. When payment is made at the time of your booking, we will process the payment through one of our third-party payment processors.
2. By authorizing and submitting payment for vacation package bookings, you consent to our third-party payment processors (i) verifying your payment method through pre-authorization or using other verification methods, and (ii) charging your payment method once the verification is complete.
3. By using your credit or debit card to pay for our service, you indicate your acceptance of and compliance with these Terms, whether or not you authorized the use of your credit card verbally over the phone or online. The cardholder is responsible for all the charges at the time of booking.
h) Tax:
i. The prices shown on our website may include estimated taxes or tax recovery fees, such as goods and services tax, local and city taxes, occupancy tax, and similar charges. While these tax amounts may be displayed on our Services, they are estimates and are not included in the pricing of our packages. You will be responsible for paying the applicable taxes directly to the Service Provider at your destination.
ii. In some locations, you may be required to pay local taxes imposed by local authorities, such as city taxes or tourist taxes. We will make every effort to inform you of any local taxes you will need to pay before finalizing your booking (as estimates on our website), provided the Service Provider has notified us of such taxes. The amount of local taxes may change between your booking date and the date of your stay. If taxes have changed by the time of your stay, you will be responsible for paying the taxes at the current rate. These taxes must be paid in local currency before your departure. For more details on applicable taxes, please consult the relevant government authorities at your destination.
i) Your Card Issuer or Banker’s Fees:
i. Some card issuers or banks may charge fees for international or cross-border transactions. For instance, if you make a booking using a card issued in a country other than the MyVacayHost location, your card issuer may apply an international or cross-border transaction fee. If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank or card issuer. MyVacayHost is not associated or responsible for any fees relating to varying exchange rates and card issuer fees.
j) Changes to Packages Post Payment:
i. Changes are typically not allowed once a booking has been made and confirmed. In the rare event that we could accommodate a change to your confirmed package, an administrative fee will be charged which starts with $95 per person and depends on the nature of the changes, days before the vacation start date and your destination.
ii. Besides the charges mentioned above, you will be responsible for any price differences resulting from changes to your Services after booking. This includes, but is not limited to, any difference in package prices or a higher room rate if there is a change in room occupancy.
iii. Cancellations:
1. Cancellation by Customer: All payments made to MyVacayHost are non-refundable. If you choose to cancel a confirmed booking, no refund or credit will be issued for any money paid to MyVacayHost. Therefore, we strongly recommend to our customers to have their travel insurance in case there is any uncertainty in travel.
2. Cancellation by MyVacayHost: For various reasons (such as war declaration or property being closed due to flooding/hurricane, etc.), a booking may be canceled or altered by the Service Provider or by us. In such cases, we will make reasonable efforts to notify you promptly and provide alternative options or assistance where possible, or offer a refund.
k) Refunds:
i. Unless stated otherwise in these Terms, all payments made to MyVacayHost are non-refundable.
ii. Refunds are not provided for bookings canceled by a customer due to inclement weather, illness, or any other circumstances beyond MyVacayHost's control; such claims should be made through your travel insurance. However, MyVacayHost does not guarantee that any refund will be issued by your travel insurance.
l) Fraud:
i. We may ask you for additional information if a booking or account shows signs of fraud, abuse, association with a government-sanctioned person or entity, or other any such suspicious activity.
ii. If we reasonably determine a customer fits into one or more of the above signs, we may (i) cancel any bookings associated with your name or email address and (ii) pursue legal action, including seeking to hold you accountable for any losses.
5. Insurance:
Prices shown do not include travel insurance. MyVacayHost strongly recommends that you have adequate travel insurance to cover all your needs, including, but not limited to, medical and cancellation insurance. In some destinations, all travelers (both foreign and local) may be required to have comprehensive medical insurance. Passengers are responsible for carefully reviewing their plan options and ensuring that any travel insurance policy covers COVID-19 or any other related health challenges.
6. Liability:
a. We own and operate our Service, while the service providers offer the Vacation Services to you. These entities are owned and operated by independent contractors. MyVacayHost is not liable for any injury or damages you may suffer in connection with your vacation packages or getaways you have selected from MyVacayHost website. Additionally, MyVacayHost and its third-party Service Providers are not responsible for Force Majeure Events, your physical, medical, or mental disabilities, or your failure to obtain valid documents or follow related instructions, which may result in denied entry at your destination or re-entry to your home country.
Certain exclusions may not apply in some jurisdictions. If you have a claim or dispute with any Service Providers, we will assist you to the best of our ability.
b. To the maximum extent permitted by law:
i. MyVacayHost will not be liable for:
• Any Services made available by the Vacation Service Providers;
• The acts, errors, omissions, representations, warranties, or negligence of any Service Providers or their employees, representatives, or agents;
• Any personal injuries, death, property damage, or other damages or expenses resulting from the above.
ii. Subject to these Terms, MyVacayHost will not be liable for any direct, indirect, punitive, special, incidental, or consequential losses or damages, whether based on negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, even if MyVacayHost has been advised of the possibility of such damages, arising from:
• The Vacation package Services,
• Use of our Service,
• Any delays or inability to use our Service,
• Use of links from our Service.
c. Except as expressly stated in these Terms, all information, software, or vacation Services displayed through our Services are provided without any warranty or condition of any kind, including but not limited to implied warranties of satisfactory quality, merchantability, fitness for a particular purpose, title, or non-infringement. MyVacayHost disclaims all such warranties and conditions.
d. MyVacayHost is not liable for any costs or expenses arising from personal injury, accidents, death, loss, damage, or delay of baggage/property, inconvenience, loss of enjoyment, disappointment, distress, or frustration, whether physical or mental, resulting from:
• The actions or omissions of any third party (including Vacation Service Providers);
• Costs or fees incurred due to relocation;
• Sickness, theft, labor disputes, mechanical breakdown, quarantine, government actions, weather, or causes beyond MyVacayHost’s control;
• Failure to obtain necessary government documents, such as passports, visas, or certificates;
• Failure to meet entry and transit requirements, including those relating to COVID-19;
• Failure to follow Service Provider instructions, rules, and requirements, including but not limited to baggage handling, and check-in/check-out times;
• Cancellation or changes to any Services (including accommodation, transfers, and activities). We reserve the right to cancel or substitute services with a comparable alternative at our discretion, and we will notify you within a reasonable time before departure of any changes. If we must cancel your booking entirely, our liability is limited to a refund of all payments received for the booking.
e. Claim Waiver. By booking through MyVacayHost, you waive any claims against MyVacayHost, its affiliated companies, and their officers, directors, employees, contractors, and agents for loss, damage, or injury caused by:
• Defects, negligence, wrongful acts, omissions, or failure of performance by any hotel, ground transportation, airline or other Service Provider;
• Inconvenience, loss of enjoyment, mental distress, or similar claims;
• Delayed departure, missed connections, substitute accommodations, service terminations, or fare changes;
• Overbooking, flight cancellations, lost or misconnected baggage, or claims arising from air transportation issues.
Under no circumstances will MyVacayHost be liable for special, incidental, or consequential damages arising from Vacation Services.
f. Services Information and Ratings. Some hotel images and room descriptions on promotional materials and our website may not depict the standard room category. Maps are not to scale. Our hotel rating system is provided for reference and may differ from other systems. We do not guarantee the accuracy of these ratings, nor that they align with other familiar systems. We reserve the right to change ratings at any time, with or without notice, and are not responsible for omissions or errors.
g. Force Majeure Events. MyVacayHost is not liable for failure or delay in fulfilling obligations due to events beyond our control, including but not limited to:
• Acts of God (e.g., floods, earthquakes, epidemics);
• War, terrorism, riots, or civil unrest;
• Government actions or national/regional emergencies;
• Strikes, industrial disturbances, or telecommunication breakdowns;
• Inadequate transportation services or supply delays.
(Each of these is a “Force Majeure Event”).
h. Confirmed bookings are not eligible for refunds in the event of a Force Majeure Event. Should such an event impact your booking, you must contact your travel insurance provider for a refund of payments made to MyVacayHost. We will assist you to the best of our abilities in obtaining refunds from third parties.
i. MyVacayHost is not liable for costs arising from adverse weather conditions or events during hurricane season or at other times, as outlined in our contractual obligations with Service Providers.
j. Agent (or Third-party). If you booked through an agent or third-party, your agent is responsible for providing you with information, verifying all details, and ensuring you understand all policies, fees, and requirements. Any third-party or agent making a booking on your behalf acknowledges this responsibility.
7. Indemnification:
You agree to indemnify, defend, and hold harmless MyVacayHost, its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Site or Services, your violation of these Terms, or your infringement of any third-party rights.
8. Privacy and Data Protection:
Your use of our Site is governed by our Privacy Policy, which can be found here. By using our Site, you consent to the collection and use of your personal information as described in our Privacy Policy.
9. Third-Party Links and Services:
Our Site may contain links to third-party websites or services that are not owned or controlled by [Your Business Name]. We are not responsible for the content, privacy policies, or practices of these third parties. You acknowledge and agree that we are not liable for any damages or loss caused by the use of such third-party services.
10. Changes to Terms:
We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page, and the "Last Updated" date will be revised. Your continued use of the Site after any changes to the Terms constitutes your acceptance of those changes.
11. General Service Terms:
a. Sports and Activities
i. Liability Waivers: You acknowledge that some Service Providers may require you to sign a waiver before participating in certain activities. If you violate any rules, your reservation may be canceled, you may be denied access to services, and any payments made may be forfeited. MyVacayHost is not liable for any costs incurred due to such violations.
ii. Information on Sports and Activities: Information provided by MyVacayHost about sports and activities is for informational purposes only and does not encourage participation. MyVacayHost is not responsible for any accidents, damage to equipment, or expenses resulting from your involvement in such activities.
b. Living Standards: Standards for utilities, services, religion, sanitary conditions, local customs, political systems, and accommodations may differ from those in USA.
c. Entry and Exit Requirements
i. You may be required to show proof of sufficient funds for your stay and admission to your next destination upon arrival.
ii. Some countries require exit permits, proof of taxes paid, or fines for overstays. You may also need to register with local authorities if you're not staying at an official hotel. Failure to comply could result in delays or fines.
d. Food, Water, and Beverages: Changes in food, water, and beverage quality or routines may lead to health issues. MyVacayHost is not responsible for any resulting costs or health problems.
e. Insects: Insects may be present inside and outside of hotels, and precautions should be taken.
f. Holidays, School Breaks, Elections, and Conventions: Availability of services may be limited during these periods, including school holidays, religious holidays, or conventions. MyVacayHost is not responsible for any inconveniences caused during these times.
g. Beaches: The condition and size of beaches may change unexpectedly due to factors like weather or seaweed presence.
h. Local Laws and Regulations: You are responsible for complying with all laws and regulations at your destination and during transit.
i. Special Needs: If you require special services or equipment due to a disability, notify MyVacayHost when booking. However, MyVacayHost cannot guarantee the availability of these services, and there may be additional costs involved.
j. Health
i. Medication: You must carry all necessary medication for travel and ensure you are fit to travel, consulting a doctor if necessary.
ii. Vaccinations: You are responsible for getting any required vaccinations and documentation for travel.
k. Pregnancy: Pregnant travelers must disclose their pregnancy at booking. Most airlines allow travel up to the 36th week of pregnancy, but restrictions may apply depending on the provider.
l. Special Requests: Requests for specific room arrangements, meals, or assistance will be forwarded to the Service Provider but cannot be guaranteed.
12. Vacation Services Specific Terms:
This section provides specific terms for the Vacation Services offered by providers and does not replace the terms and conditions given before booking. If there is any conflict, the Service Provider’s terms will prevail.
a. Cruises
i. Registration: Passengers must complete online registration with the cruise provider before departure to receive their documents. Failing to register on time may result in delays and additional fees at the pier.
ii. Fuel Surcharges: Cruise lines may charge a fuel supplement if oil prices exceed certain thresholds.
iii. Dining: Dining time and table requests are subject to availability and may not be confirmed before departure.
iv. Refunds: No refunds will be issued for unused services, weather-related cancellations, or illness. Refunds must be claimed through travel insurance.
v. Travel Documentation: Passengers must ensure they have the required travel documents. Failing to do so could result in denied boarding or cancellation without refund.
vi. Special Needs: Passengers requiring accessible rooms or special arrangements must provide a medical certificate in advance.
vii. Pregnancy: Pregnant women in late pregnancy may not be allowed to sail, with exceptions in earlier stages.
viii. Minors: Minors must be accompanied by an adult and may face age-related restrictions on alcohol, gambling, and sailing.
ix. Denial Due to Fitness for Travel: Passengers may be denied boarding if they are deemed unfit for travel by the ship's doctor or captain.
b. Hotels
i. Reservations: MyVacayHost books hotel rooms on your behalf.
ii. Requirements: Some hotels may require a deposit at check-in.
iii. Local Taxes: Local taxes and fees may apply and are payable in the local currency.
iv. Hotel/Room Allocation: Room allocation varies by hotel and may depend on availability. Requests for specific room locations may incur extra fees.
v. Check-In/Check-Out: Hotel check-in times typically range from noon to 3 p.m., and check-out is generally by 11 a.m.
vi. Intermediate Season: Some hotel services may be unavailable between May and November.
vii. Meals: The number of meals included depends on the selected package. No refunds are given for unused meals.
c. Excursions: Optional excursions may be available at additional cost. MyVacayHost is not responsible for any issues arising from participation in such activities.
13. Reviews, Comments and Photos:
a. Submissions to Our Service
By submitting any content to our Service (e.g., property reviews, photos, videos, questions, comments, suggestions, ideas, etc., collectively referred to as "Submissions"), you:
i. Confirm that all your Submissions are original and that you hold all the necessary rights to allow us to use them as described in these Terms;
ii. Grant MyVacayHost a non-exclusive, royalty-free, perpetual, transferable, irrevocable, and fully sub-licensable right (as permitted by law) to use, modify, adapt, translate, distribute, publish, create derivative works, and publicly display and perform the Submissions worldwide across any media, now known or developed in the future;
iii. Agree that MyVacayHost may use your name in connection with your Submissions (e.g., listing your first name and hometown on a review), in a non-identifiable way, at our discretion. We may also share your Submissions with Service Providers;
iv. Acknowledge that Submissions are non-confidential and non-proprietary; and
v. Agree to comply with the content guidelines outlined in these Terms when making Submissions.
b. Rights
i. You waive any moral rights (including attribution or integrity rights) that may apply to your Submissions, to the extent allowed by law;
ii. You grant MyVacayHost the right to take legal action against anyone who violates your or MyVacayHost's rights in the Submissions;
iii. You have no objection to MyVacayHost or its licensees using, modifying, deleting, or exploiting your Submissions, and we may do so without prior notice to you;
iv. MyVacayHost does not claim ownership or endorsement of, or affiliation with, any Submissions you make.
c. Liability
You are solely responsible for any damages resulting from your failure to follow these rules or any harm caused by your Submissions.
d. Prohibited Content
You are entirely responsible for the content you submit. You must not post or transmit any content to or from our Service that:
i. Is illegal, threatening, defamatory, obscene, pornographic, or violates any law or rights of privacy or publicity;
ii. Is commercial in nature, such as solicitation, advertising, or marketing of products or services;
iii. Infringes on or violates any third-party copyright, trademark, patent, or other proprietary rights; or
iv. Is objectionable based on public interest, morality, order, security, or national harmony.
14. Comments, Consents and Claims:
a. Incident Reporting
Regardless of MyVacayHost’s liability, any incidents such as injuries, service cancellations, or dissatisfaction must be reported to the emergency contact at your destination so they can assist you.
b. Customer Conduct
MyVacayHost and its Service Providers are committed to treating all customers with the highest level of respect, and we expect our customers to extend the same courtesy to our staff and fellow travelers. MyVacayHost and its Service Providers will not tolerate any abusive, violent, destructive, threatening, or harassing behavior under any circumstances

15. Privacy and Personal Information:
We are dedicated to safeguarding the privacy, confidentiality, and security of the personal information you provide to us. To better understand our practices, please review our current Privacy Policy, which also governs your use of our Service and is incorporated into these Terms by reference.
16. Assignment:
MyVacayHost has the right to assign, subcontract, or delegate any of its rights, duties, or obligations under these Terms, while you are not permitted to do so.
17. Third-party Rights:
Unless explicitly stated, these Terms are not intended to be enforceable by anyone who is not a party to them. No third party needs to provide consent for the waiver, modification, or termination of any part of these Terms. These Terms do not create any rights for third parties to enforce any part of them under applicable laws or regulations.
18. Survival of Obligations:
Any provisions of these Terms that impose obligations beyond the expiration or termination of these Terms will remain in effect after such expiration or termination.
